Terms & Conditions Your booking with Baroque Tours is subject to the following: 1. Quotations and Prices All prices quoted by Baroque Tours are based on accommodation and airfare rates, land and other travel costs, transfers, cruises and tours (‘the tariffs’) and the rates of exchange prevailing at the time of quotation. Baroque Tours reserves the right to adjust its prices in accordance with airfare, accommodation and other increases in the tariffs and/or variations in currency fluctuations that occur subsequent to your being given an estimate by Baroque Tours or its agent, until full payment has been provided and the booking is not subsequently amended after full payment. 2. Airport and Port Taxes All quotations exclude airport and port taxes and levies. In the case of those countries, which require pre-payment of airport taxes prior to the issuing of documentation, you will be invoiced for the airport taxes which must be prepaid to Baroque Tours prior to any documentation being issued to you. In the case of those countries, which only require payment of airport taxes prior to departure from the country, you will pay the airport taxes at the airport or departure point. In the same way, you will pay port taxes and airport levies for car rental at the port and/or airport. 3. Reservations On making a reservation made less than 8 weeks prior to departure, you must pay the total amount of your reservation to Baroque Tours before the reservation will be processed and failure to pay the full amount within 48 hours shall nullify the estimate. When making a reservation more than 8 weeks prior to departure you must pay a non-refundable, non-transferable deposit equal to the greater of 10% of the total price or R500 per person within 48 hours of your being provided with an Invoice as failure to do so will nullify the estimate. The full balance of the price must be paid not later than 8 weeks prior to departure. In all cases Baroque Tours reserves the right to cancel any reservation if the total price and all airport and other taxes due have not been paid to Baroque Tours 8 weeks prior to departure, in which event all amounts paid by you to Baroque Tours shall be forfeited and may be retained by Baroque Tours as liquidated damages. 4. Late Booking Fee In all cases where a booking is made less than 30 days prior to departure, Baroque Tours shall, at its discretion, be entitled, in view of the high costs of overseas communication, to levy a late booking fee of R200. 5. Amendments Due to the extra costs involved, Baroque Tours shall, in all cases, levy a R100 amendment fee for each occasion that you wish to amend a confirmed estimate or reservation. Baroque Tours shall require that you pay the R100 amendment fee in advance before it will endeavour to amend the estimate or reservation, which amendment shall always be requested on a subject to availability basis. 6. Minimum Booking Fee Due to the high cost of transactions Baroque Tours shall, at its discretion, be entitled to levy a 10% service fee on all reservations of less than R1000. 7. Group Travel All product, specials, rates and offers contained in Baroque Tours brochures are usually only valid for Individual Travel and may therefore not be valid for Group Travel for groups of 10 or more people travelling together. 8. Delays and/or Cancellations Baroque Tours shall not be responsible for any delays and/or cancellations either prior to departure, or during the course of any travel undertaken, whether caused by technical difficulties, strikes, weather, or any other circumstance whatsoever, foreseen or unforeseen. You will be responsible for all expenses incurred relating to any unscheduled extensions (e.g. hotels, meals, flights, telephone calls, clothing, toiletries, etc.) 9. Unused Services No refund will be considered for any unused services irrespective of whether they form part of the basic inclusive price, or whether they are in respect of pre-booked optional and/or additional arrangements. 10. Hotels, Apartments, Ship Berths, etc. Baroque Tours reserves the right to change requested hotels, apartments, ship berths, etc. to that of a similar grade, or better, even after departure from 11. Itinerary Variation While every effort is made to keep to published itineraries or itineraries quoted for, Baroque Tours reserves the right to make changes, if, at its discretion, it considers it in your best interest that it do so or if unforeseen circumstances result in this becoming necessary. Any variation or change to any itinerary does not constitute grounds for you to claim a refund. 12. Passports, Visas, Documentation, Re-confirmations of Flights You should have and obtain at your own expense and risk a valid passport, visa, re-entry permit, health documents, inoculations, and all requisite and correct documentation before you depart. Baroque Tours shall not be responsible for any consequences whatsoever arising from your failure to comply with health, passport, drivers’ license and any other requirements. You are fully responsible for re-confirming all of your flights not less than 72 hours prior to departure. Baroque Tours shall not be held responsible for any act or omission whether negligent or otherwise which occurs during the visa acquisition process and which results in any form of loss whatsoever. 13. Liabilities Baroque Tours makes every effort to ensure that all arrangements and services connected with its travel programmes will be carried out as specified in the most efficient and effective way possible. However as it does not have direct control over services provided by its suppliers, for whom it is acting in the capacity as agents, Baroque Tours shall not be liable for changes, omissions or delays, before or during the course of any of the holidays, whether occasioned by technical difficulties, weather conditions, strikes, communication breakdowns, or any other cause whatsoever. 14. Cancellations If, for whatever reason, you cancel a reservation you must do so in writing and you shall be liable to Baroque Tours for cancellation charges, levied and payable as below: Period of cancellation: Amount forfeited > 8 weeks before departure 20% of total price 6-8 weeks before departure 30% of total price 4-6 weeks before departure 50% of total price 2-4 weeks before departure 60% of total price < 2 weeks before departure 100% of total price If you miss any departures or fail to leave when scheduled, no portion of the price is refundable. All cancellation fees are subject to Value Added Tax. 15. Prices do not include Prices do not include any items not actually specified as being inclusive. Transfers between airports, harbours and hotels as well as entertainment, sports, meals and beverages are not included, unless specified as inclusive. Telephone calls and all other items of a personal nature are excluded. 16. Special Requests Please specify any special requests you may have when you make your booking. Baroque Tours will make every effort to comply with special requests but shall not be liable if special requests, for whatever reason, are not met. 17. Responsibility Clause Baroque Tours acts as an agent only in developing, operating and selling holidays, tours and all other travel arrangements and as these are not under the control of Baroque Tours, you agree that Baroque Tours shall not be liable for any loss, damage, injury, accident, medical expenses, illness, death, delay or any other irregularity that may be occasioned by any defect in any vehicle, or other form of conveyance, or other form of equipment, or by error or default of any body corporate or person engaged in conveying you and in carrying out travel arrangements for you, or otherwise in connection therewith, or from whatsoever cause. You also agree that Baroque Tours shall in addition not be liable to you for consequential losses or damages you may suffer. 18. Hotels, Apartments, Villas, Lodges and other Accommodation Baroque Tours seeks written confirmation from all hotels, lodges, apartments and villas that all of the information, services, facilities and the gradings it provides about hotels, lodges, apartments and/or villas is accurately and truthfully represented in Baroque Tours brochures and/or advertising. As a result, if you make a claim of poor standards of service, non-availability of services and/or misrepresentation, you agree that your claim shall be made against the hotel, lodge, apartment, villa or other accommodation provider for whom Baroque Tours is acting as an agent, and not against Baroque Tours. Gradings of properties are subject to constant review and change, so it is possible that the grading of properties shown in a Baroque Tours brochures may vary by the time that you make a booking. 19. Brochure Information, Descriptions and Offers All information published in Baroque Tours Brochures, Info Guides and/or Info Packs is accurately compiled, checked and re-confirmed prior to going to print. It is however possible that by the time you read any of Baroque Tours brochures, that the information, rates & offers contained in it may have varied or may no longer be applicable. 20. Sea Facing Rooms and Suites Except where stipulated to the contrary, you will be accommodated in a standard bedroom. If you would like to stay in a sea-facing room, suite or any other type of bedroom an additional charge shall apply. 21. Itinerary Cancellations Baroque Tours reserves the right to cancel any reservation prior to departure, in which event you will be refunded the entire amount paid by you without prejudice and without any further obligation or any further liability to you by Baroque Tours. 22. Airline Responsibility The Passenger ticket in use by the airline, when issued, shall constitute the sole contract between the airline and the purchaser of these tickets and/or the passengers using them. 23. Insurance Baroque Tours offers Travel Insurance at special low rates. If you decide not to take advantage of this Insurance, Baroque Tours reserves the right to require you to prove that you have adequate alternate insurance. 24. Legal Costs In the event of Baroque Tours instituting legal proceedings against you resulting from non-payment of an amount due to Baroque Tours by you, you agree to pay all legal costs incurred, on an attorney and client scale. Service Providers Special Conditions If special terms and conditions regarding deposits, payments and cancellation fees are imposed by any of Baroque Tours service providers, Baroque Tours shall be entitled, but shall not be obliged, to impose these special terms and conditions upon you. If imposed, these conditions shall supersede any conflicting conditions contained herein. 26. Variation of Conditions No variation of these Conditions shall be valid unless reduced to writing and confirmed by the signatures of at least two Directors of Baroque Tours. 27. Conflict with the Laws of If any of these conditions are in conflict with the laws of
